Evidentiary Requirements for O-1 Visas

USCIS has issued an update to the Policy Manual with regard to O-1 Requirements. One clarification explains that a separate legal entity owned by the beneficiary, such as a corporation or limited liability company, may file a petition on the beneficiary’s behalf. There must be a clear distinction between the beneficiary and the employing entity and the element of supervision and control must be established through documentation.
